The parents of Joseph Tutaj, the Long Island teenager who died while on a school band trip, are planning to file a lawsuit over their son’s death. Tutaj died on February 19th while in Los Angeles to play at Disneyland with the Seaford High School marching band.Tutaj came down with chills, fever, and cough, and suddenly collapsed. An autopsy showed that Tutaj died of strep infection.
The lawyer for the family, Jack Grossman, said that a notice of claim will be filed against the Seaford School District. The family claims that the 15-year old was not properly supervised and that is a leading cause in his death. In addition, legal action is also possible against the California hospital, because they didn’t treat or properly diagnose Tutaj.
Joseph was a star in the Seaford High School Marching Band. He played both the French horn and the trumpet, and participated in many other activities, including math competitions, Model Congress, and the Boy Scouts.
Unfortunately, the Tutaj family is no stranger to tragedy. Joseph’s father is battling stage four cancer and the family lost their home during Superstorm Sandy.
